Terms of Service for Brain Spill

1. Acceptance of Terms

By downloading, installing, or using the Brain Spill application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, including visitors, unregistered users (Guest mode), and registered account holders.

2. About Brain Spill

Brain Spill is an ADHD-friendly note-taking application that uses artificial intelligence to help users capture, organise, and act on their thoughts. The App is operated by Brain Spill.

3. Eligibility

You must be at least 13 years old to use Brain Spill. By using the App, you represent that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian.

4. User Accounts

Guest mode

You may use the App without creating an account. Guest tasks and notes are stored on your device and are not backed up to your account. If you choose an AI feature, the selected content is sent for processing only after you grant separate permission, as described in our Privacy Policy.

Registered account

An account is required for cloud backup and sync. Guest users can also use AI features subject to usage limits and permission. If you register, you are responsible for:

  • Keeping your login credentials secure
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorised access at support@brainspill.net

5. Subscriptions and Payments

Brain Spill offers a free tier and a paid "Brain Spill Plus" subscription. The available plans, prices, billing periods, and features are shown in the App before purchase.

Billing

iOS subscriptions are billed by Apple through the App Store; Android subscriptions are billed by Google through Google Play. The applicable store processes payment under its own terms. RevenueCat helps us verify subscription access.

Auto-renewal

Subscriptions renew automatically for the period shown at purchase unless you cancel before the next renewal. The store shows your renewal date and price in your subscription settings.

Cancellation & Refunds

You can manage or cancel an iOS subscription in your Apple account settings and an Android subscription in Google Play. Cancellation stops future renewals; access normally continues through the paid period. Request refunds from the store that billed you, subject to its refund policy.

Price changes

We reserve the right to change subscription prices. You will be notified of any price changes before they take effect and will have the opportunity to cancel.

6. Your Content

You retain full ownership of all notes, voice recordings, tasks, and other content you create in the App ("Your Content").

By using the App, you grant Brain Spill a limited, non-exclusive licence to process, store, and transmit Your Content solely to provide the App features you use, such as AI processing and account sync. We do not claim ownership of Your Content or use it to train our own AI models. We share it with service providers only as described in our Privacy Policy.

You are solely responsible for the content you create and store in the App.

7. Acceptable Use

You agree not to use the App to:

  • Violate any applicable laws or regulations
  • Upload or store illegal, harmful, or offensive content
  • Attempt to gain unauthorised access to any part of the App or its infrastructure
  • Reverse engineer, decompile, or disassemble the App
  • Use automated tools to scrape, exploit, or abuse the AI features
  • Impersonate any person or entity
  • Interfere with the App's operation or other users' experience

We reserve the right to suspend or terminate your account if you violate these terms.

8. AI Features

Brain Spill uses OpenAI to transcribe audio and to generate summaries, notes, tasks, and suggestions. Before the App sends your selected recording or text for AI processing, it asks for your separate permission. You can decline and continue using manual features. When you choose to use AI features, please note that:

  • AI-generated content may be inaccurate, incomplete, or unsuitable — always review AI output before acting on it
  • Your selected voice recordings, typed text, resulting transcripts, and relevant task context are sent through Brain Spill to OpenAI as described in our Privacy Policy
  • AI features are subject to availability and usage limits, which may change

9. Intellectual Property

All intellectual property rights in the App — including its design, code, logos, and brand — are owned by Brain Spill or its licensors. These Terms do not grant you any rights in the App other than the limited licence to use it as described herein.

"Brain Spill" and its logo are trademarks of Brain Spill. You may not use them without our prior written consent.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or completely secure. We are not responsible for any AI-generated content or for the suitability of the App for any specific purpose, including use as a medical or therapeutic tool.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Brain Spill shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of or in connection with your use of the App.

Our total liability to you for any claim arising from your use of the App shall not exceed the amount you paid to Brain Spill in the 12 months preceding the claim, or €10, whichever is greater.

12. Account Deletion

You may delete your account in the App. If you cannot access it, you can request deletion by email from this page:

Account deletion removes the account and associated notes and tasks from the active account database. It does not immediately erase operational logs, backups, separately stored files, or content already sent to a third-party processor. See the Privacy Policy for details. The deleted account cannot be restored through the App.

13. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you breach these Terms or if we discontinue the App.

Upon termination, your right to use the App ceases immediately. Sections 6, 9, 10, 11, and 15 of these Terms survive termination.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected by updating the "Last updated" date at the top of this page. We may notify you of significant changes in the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

Applicable law governs these Terms. Nothing in them removes mandatory consumer protections that apply where you live.
