Terms of Service for Brain Spill

1. Acceptance of Terms

By downloading, installing, or using the Brain Spill application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, including visitors, unregistered users (Guest mode), and registered account holders.

2. About Brain Spill

Brain Spill is an ADHD-friendly note-taking application that uses artificial intelligence to help users capture, organise, and act on their thoughts. The App is operated by Brain Spill.

3. Eligibility

You must be at least 13 years old to use Brain Spill. By using the App, you represent that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian.

Brain Spill offers a free tier and a paid "Brain Spill Plus" subscription that unlocks additional features.

6. Your Content

You retain full ownership of all notes, voice recordings, tasks, and other content you create in the App ("Your Content").

By using the App, you grant Brain Spill a limited, non-exclusive licence to process, store, and transmit Your Content solely for the purpose of providing the App's features (e.g. AI processing, cloud sync, and backup). We do not claim ownership of Your Content and we do not use it for marketing, training AI models, or sharing with third parties beyond what is described in our Privacy Policy.

You are solely responsible for the content you create and store in the App.

7. Acceptable Use

You agree not to use the App to:

• Violate any applicable laws or regulations
• Upload or store illegal, harmful, or offensive content
• Attempt to gain unauthorised access to any part of the App or its infrastructure
• Reverse engineer, decompile, or disassemble the App
• Use automated tools to scrape, exploit, or abuse the AI features
• Impersonate any person or entity
• Interfere with the App's operation or other users' experience

We reserve the right to suspend or terminate your account if you violate these terms.

8. AI Features

Brain Spill uses third-party AI services (including OpenAI) to provide features such as voice transcription and note/task generation. By using these features, you acknowledge that:

• AI-generated content may be inaccurate, incomplete, or unsuitable — always review AI output before acting on it
• Your voice recordings and text inputs are processed by third-party AI providers as described in our Privacy Policy
• AI features are subject to availability and usage limits, which may change

9. Intellectual Property

All intellectual property rights in the App — including its design, code, logos, and brand — are owned by Brain Spill or its licensors. These Terms do not grant you any rights in the App other than the limited licence to use it as described herein.

"Brain Spill" and its logo are trademarks of Brain Spill. You may not use them without our prior written consent.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or completely secure. We are not responsible for any AI-generated content or for the suitability of the App for any specific purpose, including use as a medical or therapeutic tool.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Brain Spill shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of or in connection with your use of the App.

Our total liability to you for any claim arising from your use of the App shall not exceed the amount you paid to Brain Spill in the 12 months preceding the claim, or €10, whichever is greater.

12. Account Deletion

You may delete your account at any time using the in-app account deletion feature. You can also request deletion through our web form:

Upon deletion, all your personal data and content are permanently removed. This action is irreversible.

13. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you breach these Terms or if we discontinue the App.

Upon termination, your right to use the App ceases immediately. Sections 6, 9, 10, 11, and 15 of these Terms survive termination.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected by updating the "Last updated" date at the top of this page. For significant changes, we will notify you within the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and applicable member state law, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts.
